# Paraguay 0% Tax Residency: Too Good to Be True? Channel: Hessel Video: https://www.youtube.com/watch?v=M3WOwo-senI Duration: 11 min Language: English Words: 2028 Transcript page: https://viewrankai.com/tools/youtube-transcript/M3WOwo-senI --- [0:00] Now that Dubai is out of the picture for many entrepreneurs, what is the new gold standard for 0% tax? You've likely seen Paraguay residency plus a US LLC everywhere online. Live anywhere, pay 0% tax, no minimum stay requirements. Sounds absolutely perfect, right? But here's the thing. There's a massive gap between how the structure is marketed online and how it actually works in practice. I've worked with multiple residency setups over the last few years, so I've seen the banking issues, compliance problems, and tax challenges that most gurus who promote this setup completely ignore. So, in this video, I'm going to break down exactly how the Paraguay residency structure works and [0:40] more importantly, where it can go completely wrong. We are diving deep into both the advantages and the risks. Let's start with the essential setup so we're clear about what we're talking about. Effectively, you leave your home country and deregister there, so you close your company, you cut your ties, and officially emigrate. Then you go to Paraguay to register there. You get your temporary residency, which then converts into a permanent residency. Through this process, you get your official ID card, a local address in Paraguay, and most importantly, tax residency. The key selling point of Paraguay is that there's no minimum stay requirement to be considered a tax resident. So, you [1:16] can go there for a few days in a year, get everything processed, and you don't actually need to live there. Not 180 days like it's in most countries, not 90 days like in the UAE, or 60 days like in Cyprus. No minimum stay requirement at all. On the company side, the usual setup is a US LLC or another low-tax entity. That gives you a legitimate business structure with US banking and US infrastructure, and because it is a pass-through entity, the profits and the taxes flow directly to you personally instead of being taxed at the company level. So, from the US side, you're not paying any tax, and in Paraguay, they [1:52] operate on what is called a territorial tax system, which means they only tax income that is generated within Paraguay's borders. So, from their side, the income you make through your LLC is also taxed at 0% since the money you make comes from outside the country. This means that on paper, you got zero tax at the corporate level and zero tax at the personal level without any loopholes or complicated structures. And since there is no minimum stay requirement, you can live anywhere in [2:19] the world while running your business. So, it sounds like the perfect international tax setup. So, an example would be you could do is something like 4 months in Thailand, 4 months in Bali, 4 months in Vietnam. You're basically constantly moving, never staying long enough in one country to become a tax resident there. But Paraguay remains your legal base. So, the key concept here is that Paraguay becomes your legal residence, not necessarily place where you live. You've got the residency documentation, tax number, the official address, everything you need for banking applications and compliance purposes, but you're not actually living there day-to-day. And this is because without a formal tax residency, so let's say you [2:57] leave your home country, but you never actually register somewhere else, you end up in this kind of legal gray zone. You don't have a real address, you don't have an official residency, so you're not paying any tax. But the problem is this, you're going to struggle opening bank accounts, use payment providers like Stripe, and overall compliance. And this is one of the problems that the Paraguay setup solves. Now, one of the first practical challenges with Paraguay is banking. As you can probably imagine, the local banking infrastructure isn't the strongest, especially if you're running an international business. That said, there are some solid options. For example, banks like Itaú in Paraguay can [3:34] hold both USD and local currency, which is useful. And one additional advantage that some people value is that Paraguay is not part of CRS. But in reality, most people don't rely on Paraguay alone for their banking, whether that's business or personal. For business, the most common setup is using remote fintech banks like Mercury, Relay, or Wise through the LLC. These are easy to set up, fully remote, and usually get approved pretty quickly. However, there are also trade-offs. These platforms are highly compliance-driven and heavily automated, and that means they can flag your account, ask for additional information about your business, or sometimes even freeze or shut down the [4:13] accounts without much warning. So, while they're convenient, they're not the most stable long-term solution. Then, on the personal side, most people look at offshore banking, not Paraguay. Common options we work with with our clients are banks in Georgia, Panama, Gibraltar, or the Channel Islands. These can work with Paraguay tax residents and allow you to keep your money safely in a [4:34] well-respected and safe jurisdiction. So, let me show you an example of how that would look like. Let's say you have a business that generates $500,000 in revenue through the LLC. That money first comes into your US business bank account, and after expenses, let's say you're left with $400,000 in profit. Because it's a pass-through entity, those profits flow directly to you as the owner, and there's no corporate [4:57] level taxation inside the LLC itself. From there, you then distribute that money into your personal accounts, in most cases, again, offshore bank accounts, for example, [music] in Gibraltar or the Channel Islands. And since you are a tax resident of Paraguay, that is where the personal tax obligation sits. And because this income is considered foreign-sourced, Paraguay doesn't tax it. At the same time, the US doesn't tax that income either. So, on paper, you end up with zero tax at both the business and a personal level, making it a 0% setup all round. And you then have the money safely in these offshore bank accounts, and you can do [5:31] with it whatever you want. Now, with all these benefits, there are, of course, also downsides, and this is the part I really want to go deep in this video. I'm not going to sugarcoat anything. The biggest issue with this setup is what I call a paper residency. On paper, everything looks perfect. You got the documents, the tax number, you got the residency, but in reality, there's no real substance behind it. You're not actually living there, and that is where your problem start. Just because Paraguay considers you to be a tax resident, doesn't automatically mean that other countries will also accept this. And the most important country [6:05] here is your home country. Now, let's take myself as an example with the Netherlands. Let's say I leave the Netherlands. I close my company, I deregister, I sell my assets, and I set up tax residency in Paraguay. I go live the digital nomad lifestyle, live around the world, and on paper, everything looks fine. But in practice, if I still have ties to the Netherlands, maybe I sometimes visit, I still have a bank account there, I maybe have family there, I might go to the dentist there, I got subscriptions there, business connections, whatever it is, all of [6:36] those things can be used against you. And countries like the Netherlands and most Western countries for that matter are very strict about this and can make a point of it. They can start asking questions, they can open a full audit, or even a full residency investigation, and look at the entire situation. At that point, they're not just going to look at your paperwork, but they're looking at your actual life. Where are you really living? Where are you spending your time? And where is your center of life? Now, an immediate weakness of Paraguay is that it doesn't have double tax treaties with a lot of countries, and this is a big deal. Let [7:09] me again explain this with an example. Let's say from the Netherlands now, I move to Cyprus. I live there, I have my residency there, but I also still spend some time back in the Netherlands. Now, for whatever reason, the Dutch tax authorities start asking questions, maybe they open a tax audit, or again, a residency investigation. In that case, there is a tax treaty between Cyprus and the Netherlands. And what that treaty does is it prevents double taxation and provides something called tiebreaker rules. So, both countries will look at your situation, where you actually spend your time, where your actual economic interest is, and where your center of [7:47] life is. And they then determine which country actually has the stronger claim to tax you. If Cyprus then wins the assessment, then Cyprus gets the right to tax you, and the Netherlands has to take a step back. This is what the treaty enforces. Now, if we compare it to Paraguay, Paraguay has very limited tax treaties. So, if I move from the Netherlands to Paraguay, but I'm not actually living there, and the Dutch tax authorities open an audit even 2 to 3 years later, and they're saying, "Look, we still think you have too many ties to the Netherlands." Then there's no treaty to fall back on. At that point, you're [8:21] essentially on your own. You have to defend your position, and you're doing that without a strong legal framework backing you. And that puts you in a much weaker position. And if you think this will never happen to me, that is honestly wishful thinking. Hope is not a strategy. In most cases, if there is going to be scrutiny, it comes from your home country. The place that already knows you, already has your data, has the strongest incentives to challenge your setup. And yes, tax authorities do this. So, what is my verdict on the Paraguay setup? I'm not here just to downplay it, because for many people, [8:53] this can be an absolute great option. But it only works under very specific conditions. You need to be someone who is truly leaving your home country and cutting all meaningful ties. That will mean no bank accounts in your home country, no registered address there, no active business entities, no long-term rentals or properties, no subscriptions, ongoing financial commitment, no frequent or extended visits, and no operational activity tied to that country. This setup only really works if you're running a fully international business with no geographic dependency, and you're not anchored anywhere. You can't have a real home base, you can't pick a country and stay there for most [9:29] of the year, unless it's Paraguay, and you need to be comfortable with moving around all the time, really living that nomad lifestyle. Now, if you're young, you're single, you have an online business, this might be perfect for you since you don't have many deep-rooted ties back to your home country yet. Because if your home country, or any other country for that matter, decides to challenge your residency and they start asking questions or open an audit, at that point it's already too late. So, that is the bottom line. A Paraguay plus US LLC structure can absolutely work, but only if you understand the conditions, the compliance requirements, [10:04] and tax residency rules involved.
